    • We identify ourselves as a part of the above-mentioned regions as the Russian Federation is located in two continents and we are interested in cooperation with countries, which enters in two regions.

Vision

Why is Creative Commons important for the jurisdiction?

Currently, protection of copyright and use of the results of intellectual activity is one of the most discussed and burning issues in a context of modernization, development of the information society and innovative development of Russia.

Increase of economic efficiency of the intellectual property objects use by the Russian rightholders is one of the basic directions of implementation of the Strategy of the Information Society Development in Russia (approved on 7th February, 2008 by the President of the Russian Federation). In this connection, the issue of CC license introduction was organized within the Section “Legislation in Information-Oriented Society” of the 7th Tver Social and Economic Forum “Information Society” held under the aegis of the Council for the Development of the Information Society under the President of the Russian Federation on 8-9th July 2010 in Tver, Russia.

The sharp discussions between the state authorities and representatives of the creative, educational and science communities regarding to the provision of the latter with the opportunity to voluntary give the copyright permissions to the public for their works regularly take place. There is a strong position of the society and creative communities in Russia that authors should have choice whether to use “all rights reserved” or alternative “some rights reserved” approach. There were several letters addressed to the President of the Russian Federation both from the public and well known authors describing pro and contra of the CC licenses introduction and asking to pay attention to this problem. However, at the moment provisions of the Part IV of Civil Code of the Russian Federation do not permit the authors to voluntary grant copyright permissions and in order to change the situation the civil legislation needs to be revised. Currently, the Council on Codification and Improvement of the Civil Legislation under the President of the Russian Federation is considering proposed revisions to the Part VI of the Civil Code, which will facilitate introduction and use of CC licenses in our country.

We believe that it is time for Russia to join the international network of CC jurisdictions where the licenses have been introduced and to stop being one of the major missing links in this chain. We also believe that use of CC licenses will positively influence on the socio-economic and innovative development of the country, boost development of the open content and broaden access of the public to it.

What do you think makes a successful jurisdiction project?

Under the existing conditions several important things need to be done to provide successful implementation of CC Project in Russia:

  1. One of the most important things is that adaptation of CC licenses to the Russian legislation is not possible at the moment because such licenses are not envisaged by the existing civil legislation. Now, the process of improvement of the civil legislation is going on under the auspices of the Council on Codification and Improvement of the Civil Legislation at the President of the Russian Federation. So, we are trying to establish cooperation with the Research Center of Private Law (“The Center”) the Head of which Mr. Veniamin F. Yakovlev and Mr. Alexander L. Makovskiy are the Chairman and First Vice Chairman of the Center are heading the Council on Codification and Improvement of the Civil Legislation at the President of the Russian Federation.

    In December 2010, the Center has published proposed revisions to Part IV, which would facilitate introduction of CC licenses in Russia, for open discussion. Particularly, the revisions state: “The rightholder can publicly state, i.e. by communicating with general public, for granting to any person of the possibility to use result of intellectual activity belonging to it on gratuitous basis, on the conditions defined by it and during the term specified to it. During this term any person has the right to use this result on the specified conditions. If the rightholder does not specify the term in its statement, it is considered that this term is 5 years.”

    Establishment of a constructive dialogue and practical relations with the people responsible for the preparation and implementation of the revisions to the existing Civil Code of the Russian Federation will allow to CC Russia team to understand the ongoing situation, participate and contribute in the process of improvement the legislation and introduction of CC licenses in our country.
  2. The second important thing is to prepare:
    • professional translation of CC Attribution 3.0 (Unported) in Russian language. Availability of the Russian text of CC Attribution 3.0, which should be perfect from the linguistic point of view and legal terminology, and will become a basis for further adaptation of CC licenses to Russian legislation;
    • professional translation of CC0.

Comment: We already have text of the CC Attribution 3.0 license, translated into Russian, which was provided to us by Syb Groeneveld, but it does not fully comply with the text of the CC Attribution 3.0 license published at CC website (www.creativecommons.org). We will compare this Russian text with the CC Attribution 3.0 text in English and will improve it from the linguistic point of view and legal terms (scientific editing). There are also several versions of Russian translations of CC Attribution 3.0, but, on our opinion, they cannot be used due to the inappropriate translation.

  1. It is also very important to widely disseminate information on CC licenses introduction process in Russia, on the idea and benefits of CC licenses for the authors. For this purpose we are developing CC Russia website, the launch of which is planned in the end February. This will help to raise awareness of the public on CC licenses, to receive feedback from the people interested in their introduction and get support of public. Our team will also maintain the website further providing translation, publication and update of the information on CC licenses and tools, which is available at CC web-site (in accordance with CC policy), including news on the situation and events related to CC licenses introduction and use in Russia. We also plan to open and maintain blogs of CC Russia team in Twitter, LJ and account at Facebook.
  2. Another important thing is adaptation of CC licenses set to the Russian legislation. Our Legal team, which includes high-qualified lawyers with a competence in the field of the intellectual property protection, will do this work. However, this should be the next step after adoption of revisions to the civil legislation by the Parliament.

How do you see the jurisdiction project contributing to the CC Affiliate Network?

We are ready to interact with the other CC Affiliates and inform them on the situation with CC licenses in Russia. We would also appreciate, if the other more experienced CC Affiliate teams exchange their experience with us. Community

Describe the communities that are currently active in the project.

Currently, not many communities are active within the Project, as CC licenses are not officially fixed in the Russian legislation and, therefore, cannot be widely used by people and organization.

We plan to attract attention of the representatives of cultural, educational, scientific and other communities to the CC licenses through:

  • CC Russia website;
  • Our partners from different communities (for example, in cooperation with Association of Webpublishers and Department of New Media and Theory of Communications of the Faculty of Journalism of Lomonosov Moscow State University);
  • Discussions of CC licenses introduction in blogs and accounts of CC Russia to be opened in Twitter, LJ and Facebook;
  • Participation in the events held by different authorities related to the intellectual property rights protection and copyright from the point of view of CC licenses introduction and use in Russia.

Describe the communities (existing or new) that you plan to focus on during the timeframe covered by this roadmap?

We plan to cover the webpublishers, cultural community (libraries, musicians, artists and other authors), as well as scientific and educational communities through our existing relations in these circles. However, intensive popularization of CC licenses should start after the improvement of civil legislation and adaptation of CC licenses to the Russian legal framework.

    • Why is it important? - It is vital to improve existing legislative framework to permit introduction and use of CC licenses in Russia. The authority mentioned above is responsible for drafting revisions of the Part IV of the Civil Code of the Russian Federation.
    • Which communities will benefit? – All communities will benefit.
  2. Focus-area: Professional Translation of CC Attribution 3.0 and CC0 into Russian
    • Why is it important? - It is important to have text of CC Attribution 3.0 and CC0 translated professionally. Russian text of CC Attribution 3.0 will be a basis for the adaptation of CC licenses suite to the Russian legislation.
    • Which communities will benefit? – All communities will benefit.
  3. Focus-area: Development of CC Russia website
    • Why is it important? - Website will be a major resource raising awareness of the public on Creative Commons activities, idea of CC licenses, what benefits can be received by creative people from use of CC license suite. News on the current situation and efforts made to introduce CC licenses in Russia will be also published at the website along with research materials and views of experts in the field of intellectual property protection and copyright. This should be the next step after the existing civil legislation is improved and use of CC licenses is fixed in the Civil Code Part IV.

  5. Focus-area: Community building
    • Why is it important? – Community building is necessary and long-term process. It should start now to attract support of the public and creative people to the idea of CC license introduction in Russia. However, the campaign on community building should start after the CC licenses are adapted to the Russian legislation.

    3. How will this output help achieve your goals? - It is important to build communities interested in using of CC licenses for the licensing works created by individual authors and organizations. When the CC licenses will be adapted to the Russian legislation there should be people aware of CC licenses and what benefits they can get from use of the licenses. The process of community building is very important because interested authors can unite their efforts and bring their opinion on the necessity of CC license introduction in Russia to the attention of the government authorities engaged in improvement of civil legislation in Russia. Broad campaign on popularization of CC licenses should start after the improvement of civil legislation and adaptation of CC licenses to Russian legal framework.

Sustainability and Scalability

We are sure that during the 2011 year the leadership of the project will not change. If preparation of the outputs takes longer period of time than it is anticipated, we will inform CC headquarters on the situation and try to agree with them the period of time, which is necessary for preparation of the concrete output.

We will be in regular contact with the representatives of CC Headquarter, who will be involved in our work on the Project, either by e-mail or by Skype, and keep them informed on the ongoing progress or setbacks within our jurisdiction. To inform CC Affiliate Network on the situation with the Project implementation within our jurisdiction we can use mailing list.

How will you document the project so that others may replicate or learn from your efforts?

We can provide written reports about the Project as requested by Creative Commons from time to time (as requested), but no less than annually, in accordance with the proposed by CC deadlines, format and requested content of the reports.

How could the jurisdiction's plans help drive or support other jurisdictions' activities?

In our Roadmap we describe the priority activities, which are necessary, from our point of view, to be implemented to introduce CC licenses in Russia. We planned necessary steps, such as CC Attrobution 3.0 and CC0 translation, CC Attribution 3.0 adaptation to the Russian legal framework, launch of CC Russia website, which are basic for the process of introduction of CC licenses in any jurisdiction. Probably, our steps and planned activities can become as an example of starting the process of introduction of CC licenses in a jurisdiction, although we are not the first jurisdiction on this way and we have some specific conditions in our country.

Attraction of volunteers, creation of animated video resources in national language, holding events and presentations etc.
