Translation process

4.0:

Creative Commons Poland coordinated the translation process. Translation draft was prepared by the legal team of CC Poland. The draft was put to public consultation from 30 July to 31 August 2016. Here is the announcement on the start of the consultation. At the same time, the translation was sent directly to the people involved in the earlier translations of CC licenses, IP lawyers, librarians and representatives of cultural heritage institutions. Blogs, social media and mailing lists were used to inform about the translation process. We haven't received any comments from outside of CC Poland.

Key translation decisions and challenges

Word choice

4.0:

• there are no significant changes in the definitions
• there is no legal translation of “as is” basis, but the meaning is explained
• “public” was translated as user (“użytkownik”), because has the widest range and is understandable to a wide audience. An alternative translation could be public (“publiczność”), a term which is used in Polish Civil Code, but its the meaning is different than in the original license.
• the term "in consideration of" was translated as in return ("w zamian za"), because it has no equivalent in the Polish legal language
• „expressly” was translated as "clearly" ("wyraźnie"), an alternative translation in consideration is „expressis verbis”
