Much of the potential value of data is to society at large — more data has the potential to facilitate enhanced scientific collaboration and reproducibility, more efficient markets, increased government and corporate transparency, and overall to speed discovery and understanding of solutions to planetary and societal needs.

A big part of the potential value of data, in particular its society-wide value, is realized by use across organizational boundaries. How does this occur (legally)? Many sites give narrow permission to use data via terms of service. Much ad hoc data sharing occurs among researchers. And increasingly, open data is facilitated by sharing under public terms to manage copyright restrictions that might otherwise limit dissemination or reuse of data, e.g. [http://creativecommons.org/licenses/ CC licenses] or the [[CC0]] public domain dedication.

Many organizations, institutions, and governments are using CC tools for data. For case studies about how these tools are applied, see:

==Frequently asked questions about data==

==='''''Can databases be released under CC licenses?'''''===

Yes, CC licenses can be used on any copyrighted work, including a copyrighted database. A CC license may be applied to any or all copyrighted aspects of a database and its contents. See [[Data#How_do_I_apply_a_CC_legal_tool_to_a_database.3F|below]] for more information regarding how to provide clear notice of what is licensed. Any use of the licensed database or its contents that is restricted by copyright law requires compliance with the relevant license conditions (BY, SA, NC, ND). In their current version (3.0) CC licenses do not require compliance with the license conditions when only sui generis database rights (and not copyright) are implicated. Additionally, the international and "ported" version 3.0 licenses, excluding EU jurisdiction ports, do not grant any permissions where sui generis database rights are implicated. Please see [[Data#How_.28if_at_all.29_are_sui_generis_database_rights_addressed_in_CC_licenses.3F|below]] for more detail.

CC0, the public domain dedication, can also be used on databases. The effect is to waive all copyright and related rights in the database, placing it as close as possible into the worldwide public domain. In certain domains, such as science and government, there are important reasons to consider using tools like CC0. Waiving copyright and related rights eliminates all uncertainty for potential users, encouraging maximal reuse and sharing of information. Where waiver is not a viable option and some conditions on reuse are necessary, rights holders should [http://www.ivir.nl/publications/eechoud/CC_PublicSectorInformation_report_v3.pdf consider] using CC licenses that give the public more freedom to reuse and remix the content.

==='''''Which components of a database are protected by copyright?'''''===

With databases, there are likely four components to consider: (1) the database model or structure, (2) the data entry and output sheet, (3) field names, and (4) the data.

The '''database model''' is a specification describing how a database is structured and organized, including database tables and table indexes. The selection, coordination, and arrangement of the contents is subject to copyright if it is sufficiently original. The threshold of originality required for copyright is fairly low in many jurisdictions. For example, while courts in the United States have held that an alphabetical telephone directory did not have sufficient originality to merit copyright protection, an organized directory of Chinese-American businesses in a particular area did. These determinations are very fact-specific (no pun intended) and vary by jurisdiction.

The '''data entry and output sheets''' contain questions, and the answers to these questions are stored in a database. For example, a web page asking a scientist to enter a gene’s name, its pathway information, and its ontology would constitute a data entry sheet. The format and layout of these sheets are protected by copyright according to the same standard of originality used to analyze copyright in the database model.

'''Field names''' describe data sets. For example, “address” might be the name of the field for street address information. These are less likely to be protected by copyright because they often do not reflect originality.

The '''data''' contained in the database are subject to copyright if they are sufficiently creative. Original poems contained in a database would be protected by copyright, but purely factual data (such as gene names without more) contained in a database would not. Facts are not subject to copyright, nor are the ideas underlying copyrighted content.

==='''''How do I know whether a particular use of a database is restricted by copyright?'''''===

When the database structure or contents are subject to copyright, reproducing, distributing, or modifying the database will often be restricted by copyright law. If the database is released under a CC license, that means reproduction, distribution, or modification will likely require compliance with the relevant license conditions, including attribution.

However, it is important to note that some uses of a copyrighted database will not be restricted by copyright. It may be possible, for example, to rearrange or modify the uncopyrightable data in a way that does not implicate the copyright in the database structure. For example, while (as noted above) a court in the United States held that a directory of Chinese-American businesses was restricted by copyright, the same court went on to hold that a directory that duplicated hundreds of its listings was not infringing because the listings were categorized and arranged in a sufficiently dissimilar way. In those situations, compliance with the license conditions is not required unless the database contents are themselves restricted by copyright.

Similarly, even where database contents are subject to copyright and published under a CC license, use of the facts and ideas found in the contents will not require attribution (or compliance with other applicable license conditions), unless doing so implicates copyright in the database structure as explained above. This important limitation of CC licenses is reflected in the license deed, where it indicates that the license does not extend to those elements of the work in the public domain.

==='''''What are sui generis database rights?'''''===

Sui generis database rights are different from, but often overlap with, copyright. Sui generis database rights exist to recognize the investment required to compile a database, whether or not the database meets the originality requirement in copyright law. Established by [http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:31996L0009:EN:HTML Directive 96/9/EC] [http://www.ksaday.com ksaday] [http://www.ksaday.com/2012/04/bermain-game.html game] of the European Parliament, sui generis database rights prohibit the extraction or reutilization of a substantial portion (defined in both qualitative and quantitative terms) of the contents of a database. The Directive has been implemented in the national legislation of all EU member countries. Outside of the European Union, similar database-like rights have been established in several countries, including Mexico and South Korea.

==='''''How (if at all) are sui generis database rights addressed in CC licenses?'''''===

The treatment of sui generis database rights varies among the CC version 3.0 licenses, but the practical result is always the same: compliance with the license conditions is not required where sui generis database rights - but not copyright - are implicated. This means that if someone takes a substantial portion of a CC-licensed database and uses it in a way that does not implicate copyright (e.g., by rearranging purely factual data), she does not have to attribute the licensor or comply with the other license conditions, even if the database is protected by sui generis database rights.

While this treatment is the same across all CC version 3.0 licenses, the reason for this outcome varies. In the ported 3.0 licenses ported to the laws of EU jurisdictions, works subject to copyright and/or sui generis database rights are licensed and subject to the CC license terms and conditions. In those ported licenses, however, the conditions of the license are explicitly waived when use of the licensed work only involves the exercise of database rights and not copyright.

By contrast, all other 3.0 licenses (including ported licenses for non-EU jurisdictions and the international licenses) do not license sui generis database rights at all. As a result, the license conditions do not (nor could they) attach to uses implicating database rights and not copyright. It also means a licensee may need separate permission if they plan to use the database in a way that implicates database rights (although there may arguably be an implied right to do so).

CC is [https://creativecommons.org/weblog/entry/29639 leaning toward] [http://www.ksaday.com/2012/01/4shared-com.html 4shared] changing how its licenses treat sui generis database rights in version 4.0. If pursued, those rights would be fully licensed and subject to the same terms and conditions as copyright, without any waiver of the license conditions where only those rights are implicated. Read more about the issue -- including important limitations that would avoid imposing restrictions where those rights do not exist -- on the [[4.0/License subject matter|version 4.0 wiki]].

==='''''How do I apply a CC legal tool to a database?'''''===

Before making a database available under a CC license, a database provider must first make sure she has all rights necessary to do so. Often, the database provider is not the original author of the database contents, which may mean the database provider needs separate permissions from third parties before publishing the database under a CC legal tool. For more information, read our [[Before_Licensing|pre-licensing]] guidelines.

Also, the database provider must consider what elements of the database she wants to be covered by the CC legal tool and identify those elements in a manner that reusers will see and understand. Please see our [[Marking/Creators|marking page]] for more information on how to clearly distinguish unlicensed content.
GreyLedhttps://wiki.creativecommons.org/index.php?title=HOWTO_Publish&diff=56512HOWTO Publish2012-04-20T13:07:35Z
GreyLed:

====Morpheus====

[http://morpheus.com/ Morpheus] is a popular windows P2P file-sharing application with support for locating and displaying Creative Commons licenses on audio files. The following steps describe the process to distributing your audio on the Morpheus network.

{|
|[[Image:1-morpheus.gif]]
|'''Step one: Use CC Publisher to add metadata to your music'''

The first step to getting your music recognized by Morpheus is to embed your license into your songs. Follow our tutorial on using CC Publisher. When you're done either publishing your song to the Internet Archive or your own website, your audio file will have the proper embedded metadata.
===Internet Archive===

You can quickly and easily publish your [http://www.ksaday.com video] files to the Internet Archive using our CC Publisher application. CC Publisher is a tool that does two things: it will help you tag your video files with information about your license and it allows you to upload Creative Commons-licensed audio and video works to the [http://archive.org/ Internet Archive] for free hosting.

CC Publisher is available for Windows, Mac OS X and Linux operating systems. Download links and installation instructions can be found on the [http://wiki.creativecommons.org/CcPublisher CC Publisher] page.

'''Using CC Publisher'''
{|
|[[Image:1-ccpublisher.gif|frame]]
|'''Step one: Dragging your video into CC Publisher'''

Start the CC Publisher application and hit Next on the introductory screen. The process starts by adding your files to be tagged/uploaded. You can use the browse function to find the files, or simply drag and drop as many files that you would like to license (all with the same license) and upload (all into the same collection at Internet Archive).
|}

{|
|[[Image:2-ccpublisher.gif|frame]]
|'''Step two: Adding information about your works'''

The next screen will ask for information about your recording or video, which will help others find it at the archive and build up the metadata in your audio/video files.
|}

{|
|[[Image:3-ccpublisher.gif|frame]]
|'''Step three: Choose your license'''

CC Publisher lets you choose one of several license types and the options for each.
|}

{|
|[[Image:4-ccpublisher.gif|frame]]
|'''Step four: Logging into the Internet Archive'''

To upload your works to the Internet Archive, you'll need an account there to associate your files with. If you don't have an account there, there is a handy button within CC Publisher that will launch a web browser and allow you to join it.
|}

{|
|[[Image:5-ccpublisher.gif|frame]]
|'''Step five: Start your upload to the Archive'''

The final step is to upload your works to the Internet Archive. Depending on your connection and the size of files you are uploading, this step can take anywhere from a few seconds to several hours.
|}

{|
|[[Image:6-ccpublisher.gif|frame]]
|'''Step six: All done!'''

When your upload is complete, the Publisher application will furnish you with a URL that should be live within 24 hours at the Archive.
====Adding a license to LiveJournal====

(Follow the first two steps above to choose a license and copy the code)

# While logged in, go to the [http://www.livejournal.com/ LiveJournal homepage] and look at the header.
* If it's a personal blog, choose "Journal" then "Journal style".
* If it's a community, choose "Communities" then "Manage," and for the community you want to mark, click "[Journal Style]" on the right.
# On the right, under "(blog name)'s current theme", click "Customize your theme".
# Click Sidebar and paste the HTML code into the relevant box. (Depending on the theme, you may need to click "sidebar" there may be one or many boxes, and you may need to click "Free Text Sidebox" to make them visible.)

Save and see how it looks.

Depending on the options you've chosen, this may look a bit bulky or messy - you may want to add <nowiki> </nowiki> tags to the text under the box.

Depending on the theme you are using, you may be able to add the mark elsewhere, e.g. in a footer (?).

Another option is to edit the CSS directly, if you know how to do this. Instead of clicking "Sidebar", click "Custom CSS" and go from there. LiveJournal's way of selectively presenting the CSS {?) differs from other blog platforms, so this can be confusing if you're not used to it. Make a copy of the previous version of the CSS into a text file, and note the settings, in case something goes wrong and you need to change it back.

CC is embarking on a versioning process for its core license suite, which we expect will result in version 4.0. The first public discussions of 4.0 were held at CC's [[Global Summit 2011]]. The public process was kicked off with a [http://creativecommons.org/weblog/entry/29639?utm_campaign=newsletter_1111&utm_medium=blog&utm_source=newsletter blog post] laying out some of the key reasons for pursuing 4.0 at this time.

Since CC's launch in 2002, it has versioned its core license suite [[license versions|three times]], the last ([[Version 3|3.0]]) in early 2007. CC licenses constitute a [http://creativecommons.org/who-uses-cc globally-recognized framework], developed in consultation with legal experts and CC affiliate institutions in [http://wiki.creativecommons.org/CC_Affiliate_Network over 70 jurisdictions]. Over 500 million CC-licensed works have been published by their authors on the Internet. Today, Creative Commons licenses, public domain tools, and supporting technologies are the global standard for sharing across culture, education, government, science, and more.

Version 4.0 is a tremendous opportunity to ensure the license suite is ideally crafted to further CC's [http://creativecommons.org/about vision and mission] over the next decades. Please participate in this important discussion.

=== Goals and objectives ===

Creative Commons staff, board and community have to date identified several goals for the next version of its core license suite tied to achieving CC's goal and mission. These include:

:: ''Internationalization'' – further adapt the core suite of international licenses to operate globally, ensuring they are robust, enforceable and easily adopted worldwide;

:: ''Interoperability'' – maximize interoperability between CC licenses and other licenses to reduce friction within the commons, promote standards and stem license proliferation;

:: ''Long-lasting'' — anticipate new and changing adoption opportunities and legal challenges, allowing the new suite of licenses to endure for the foreseeable future;

:: ''Data/PSI/Science/Education'' — recognize and address impediments to adoption of CC by governments as well as other important, publicly-minded institutions in these and other critical arenas; and

:: ''Supporting Existing Adoption Models and Frameworks'' – remain mindful of and accommodate the needs of our existing community of adopters leveraging pre-4.0 licenses, including governments but also other important constituencies.

=== Organization and purpose of this wiki ===

This wiki is the central location for documenting key discussion topics and suggestions for improving the license suite in version 4.0, together with supporting information and relevant links. It is intended to supplement, not replace, the CC license discuss email list [http://lists.ibiblio.org/mailman/listinfo/cc-licenses (subscribe)] [http://www.ksaday.com ksaday] that will serve as the main discussion forum for the versioning process just as it has with prior versioning efforts.

CC has pre-populated the wiki with key topics identified to date. We ask contributors to be thoughtful about placement of additional and related topics, and the creation of new pages altogether. Before starting a new page, consider posting the suggestion to the [[4.0/Sandbox|Sandbox]]. We would also prefer (but do not require) that contributors use their real names when editing the wiki.

=== Process ===

As a license steward and steward of the commons, our goal for the process is to ensure utmost transparency and inclusiveness. The 4.0 process will be conducted in line with our prior versioning efforts, with periodic publication of license drafts for public comment and documentation of issue resolution as that occurs. One important difference from our past efforts, however, is a formal requirements gathering period that will run for a period of time prior to publication of the first draft. During this period, we strongly encourage the broadest participation possible by everyone with an interest in the commons and the role open licensing plays in its future.

The primary discussion forum for issues relating to the 4.0 versioning process will be the CC license discuss email list. Please [http://www.ksaday.com/2012/04/foto-bayi-lucu.html foto bayi lucu] [http://lists.ibiblio.org/mailman/listinfo/cc-licenses subscribe] and add your voice to this important effort.

=== Draft timeline ===
The dates noted below are approximate and subject to change. The number of drafts and public comment periods may vary depending on the number and type of issues raised and how they are resolved, among other things. Watch this page for updates, including major events such as affiliate regional meetings where 4.0 discussions will take place.
=== Items for discussion ===

Various aspects of the license suite ''potentially'' could be improved in the version 4.0 licenses. We will gather and rigorously debate and analyze these items and corresponding proposals for handling them in version 4.0. We encourage the broadest possible engagement in this process. This is a particularly important goal during the requirements gathering stage when everyone is strongly encouraged (and our affiliates are expected) to provide feedback on proposed changes and suggest other changes they would like to see. Add, improve, and discuss specific items in the pages linked below.
'''If you do not find a suitable existing page and category for an item you would like to propose or discuss, please add it to the [[4.0/Sandbox]] where suggestions for new pages will be aggregated.'''

Finally, we encourage contributors to take the time to review [http://wiki.creativecommons.org/License_Versions prior versioning efforts], including relevant discussions of important topics previously debated by the CC community and discussions related to their resolution. Being aware of and taking those into account will be important to an effective and efficient process, particularly if a request is made to revisit and potentially change direction in 4.0.

http://search.creativecommons.org will help you find photos, music, text, books, educational material, and more that is free to share or build upon utilizing Creative Commons enabled search services at [http://www.google.com/advanced_search Google] and [http://flickr.com/search/advanced/ Flickr]. You can also access this tool via the [http://getfirefox.com Firefox web browser]. Find out more about [[Firefox and CC Search]].

==Why is this important?==

Copyright applies fully and automatically to any work -- a photograph, a song, a web page, an article, pretty much any form of expression -- the moment it is created. This means that if you want to copy and re-use a creative work you find online, you usually have to ask the author's permission.

This "all rights reserved" protection is a good thing for many authors and artists. But what about those who want you to use their work freely without permission -- but on certain conditions?

This search service helps you quickly find those authors and the work they have marked as free to use with only "some rights reserved." If you respect the rights they have reserved (which will be clearly marked, as you'll see) then you can use the work without having to contact them and ask. In some cases, you may even find work in the public domain -- that is, free for any use with "no rights reserved."

==Examples==

Looking for a picture of a giraffe for a school report? Type "giraffe," choose the Flickr tab, and [http://search.creativecommons.org/?q=giraffe&engine=flickr see what you find].

Interested in music free to download and put in a movie? Type the kind of music you're looking for, choose the [http://www.ksaday.com Google] or Yahoo! tabs, and browse results from across the web.

Try it out. Look for books, weblogs, audio recordings, and more.
==Does CC Search only return CC-licensed content?==

search.creativecommons.org offers convenient access to search services provided by other independent organizations. Selecting different search options within the result list -- particularly Image
search for Google and Yahoo -- may lead to the inclusion of results which are not Creative Commons licensed.

You should always verify that the work you are re-using has a Creative Commmons license attached to it.
