She is currengly a doctoral student at the UAB in Barcelona, Spain but lives and works in Bogotà..<br />

Carolina Botero is a researcher, lecturer, writer and consultant on issues related to law and technology. She has developed a special interest on the challenges that the educational sector faces regarding copyright issues while working with Karisma Foundation in Bogotá. She is an active member of the Colombian Free Software community and co-leader of Creative Commons in Colombia. As a consultant she has worked for several Universities in Colombia like the National University and the Andes University. She is consultant for the Bogota Telecomunications Corporation (ETB) and the Ministry of Agriculture. She has supported the adoption of open standards in elearning projects such as the UNDP Virtual School for Latinamerica and the Caribbean, or the Virtual Sports School of Coldeportes (the Colombian sports authority).<br />
She is leading the Law, Internet and Society group inside the Karisma Foundation. This group is in charge of the Creative Commons project at the foundation and she excecises the personal coleader role of Creative Commons from this possition too.<br />

Studied Social Communication – Journalism at the Universidad del Valle (Cali, 2010). She studied music for many years, but finally decided to work on media. During college she worked on journalism, radio and audiovisual issues. Her experience includes building digital contents and on doing so she has developed a major concern for how this construction is done.<br />

HECTOR BOTERO<br />
He is an Engineer that has worked on Technology inception in different environments, from the entreprenurial area to different educational uses. In the 1990s he was already working on ICT in education in Colombia, first developing educational software, soon working on virtual educational projects and also as a digital publisher. Along with some other family members at the end of the 1990s he started the Karisma Foundation in order to support ICT adoption especially in educational institutions. He gaves consultancy on the issues of his expertise and conducts specific projects of the Foundation that works on the frame of bottom-up community innitiatives that support local capacities and resources, selflearning process and the necessary inception of ICT.<br />

===Why is Creative Commons important for the jurisdiction?===<br />
Colombia has been traditionally very supporting of strong copyright legislative structures despite the fact of being in the third world and having a multiethnic population with a very diverse views of the creative process. CC shows some of the copyright current problematic issues and align them from a legal perspective that could be of good use in our country.<br />
From our own perspective, considering that the Foundation’s mission is to support the diffusion and good use of Information and Communication Technologies (ICT) in the Colombian society, we believe Creative Commons is an important tool that could be implemented in the different sectors of the Colombian society. <br />
It is so especially because Karisma has worked mainly with educational institutions since its inception, providing content and support for the use of ICTs in the learning process. “Open” ideas, problems and solutions are present from the start. The scope of Karisma´s work now supports the appropriation of ICT in many other sectors—in this context, we also find it very useful and important to be associated to the Creative Commons licences and the networks that are related to them.<br />
Leading Creative Commons activities in Colombia is easy to match with our current normal activities; analysis, consultation, proposals, trainings, teaching materials, legal advise and analysis on ICT issues, as well as the design and organization of conferences and seminars on ICT appropriation, especially regarding educational, citizen and cultural matters.<br />

===What do you think makes a successful jurisdiction project?===<br />
a. The fact that the normal activities of the affiliates are easily related to CC activities, because then the effort that the CC project requires is part of the day-to-day work and has a direct benefit for the affiliate.<br />
b. The affiliate needs to have a commitment with openness not just on the “conceptual” or “theoretical” part of the idea but also in terms of the affiliates' approach towards others. The project has to be open for people and institutions in the jurisdiction to ask questions, find support and get involved with Creative Commons ideas, The affiliates has to be first a catalyst and then the expert.<br />
c. The affiliate must build a network on the national and international level that allows the project to have communicating vessels, a real network that allows the project to grow and learn from others<br />

We have been working in the open world for various years. During this period of time:<br />

We can be an example: we have supported the startup and rise of different projects that had adopted these ideas enhancing their impact in Colombia and showing some local awareness and role in the inception of the concept. For example, today more than 7 Colombian Universities are part of the OCWC project, and 3 of them had been close to us. Also other 2 projects that work with elearning models out of the formal structure (UNDP and Escuela Virtual del Deporte) had also adopted OER standards. Lately we are also getting involved with important projects regarding Digital Libraries and Institutional Repositories, this will allow us to have in the close future more knowledge and specific projects to think about this issues.<br />
b. We have built our own expertise on the project that we can share with others. This expertise is relevant not only to the difussion of the project in our country but also in relation with other regional and worldwide projects. Carolina Botero has already participated for the last 2 years in international seminars not just under our umbrella but also on behalf of CC showing local and regional experiences, and we have been engaged in some international projects through her too (such as CClearn, research projects with the FGV University in Brasil and Derechos Digitales in Chile)<br />

We are committed to collaborative and participatory activities as part of networks that are involved in open projects at different levels; so we are also willing to learn from others and work with them. Colombia has been traditionally very supporting of strong copyright legislative structures despite the fact of being in the third world and having a multiethnic population with a very diverse views of the creative process. CC shows some of the copyright current problematic issues and align them from a legal perspective that could be of good use in our country.<br />
From our own perspective, considering that the Foundation’s mission is to support the diffusion and good use of Information and Communication Technologies (ICT) in the Colombian society, we believe Creative Commons is an important tool that could be implemented in the different sectors of the Colombian society. <br />
It is so especially because Karisma has worked mainly with educational institutions since its inception, providing content and support for the use of ICTs in the learning process. “Open” ideas, problems and solutions are present from the start. The scope of Karisma´s work now supports the appropriation of ICT in many other sectors—in this context, we also find it very useful and important to be associated to the Creative Commons licences and the networks that are related to them.<br />

Carolina Botero is a researcher, lecturer, writer and consultant on issues related to law and technology. She has developed a special interest on the challenges that the educational sector faces regarding copyright issues while working with Karisma Foundation in Bogotá. She is an active member of the Colombian Free Software community and co-leader of Creative Commons in Colombia. As a consultant she has worked for several Universities in Colombia like the National University and the Andes University. She is consultant for the Bogota Telecomunications Corporation (ETB) and the Ministry of Agriculture. She has supported the adoption of open standards in elearning projects such as the UNDP Virtual School for Latinamerica and the Caribbean, or the Virtual Sports School of Coldeportes (the Colombian sports authority). <br />

MARIA JULIANA MARIA JULIANA SOTO - Studied Social Communication – Journalism at the Universidad del Valle (Cali, 2010). She studied music for many years, but finally decided to work on media. During college she worked on journalism, radio and audiovisual issues. ANDREA PAOLA SANCHEZ - Andrea holds a bachelor honors degree in Media Culture and Communications from Greenwich University in London (2005). She currently finished her law degree from los Andes University and will be graduating in March 2011. Her thesis focused on the study of the adoption of Open Access policies and the use of Creative Commons Licences in Colombia’s Digital Library BDCOL (Biblioteca Digital Colombiana). HECTOR BOTERO - He is an Engineer that has worked on Technology inception in different environments, from the entreprenurial area to different educational uses. In the 1990s he was already working on ICT in education in Colombia, first developing educational software, soon working on virtual educational projects and also as a digital publisher. Along with some other family members at the end of the 1990s he started the Karisma Foundation in order to support ICT adoption especially in educational institutions. In developing awareness and training in areas at the intersection between technology, education and copyright, Karisma Foundation has been developing “learning while doing” workshops in the line that enable teachers, librarians, publishers, researchers, students, etc., to address the problem and come up with possible solutions, we had design a 5 years project that will develop this kind of activities for different audiences.<br />

As part of this major project Karisma has identified that the process of creating open educational resources, as with any other content, needs an understanding of the legal system of copyright and requires addressing open licensing issues that are usually complicated. Therefore one of the first activity that has been developed from the workshops that Karisma does in Colombia seeks to facilitate face-to-face educational activities for teachers involved in the production of Open Educational Resources (OER). The first community to address during the 1st year of the major project is therefore educators.<br />

We need to further encourage connections among people and projects that will solidify our network and foster a stronger network environment in our jurisdiction.<br />

We have been doing special seminars every year since the launch of CC licenses in 2006 and it has shown to be an important forum and gathering point. We would like to maintain this initiative.<br />
<br />
This strategy is more open and wants to cover a broad audience, those that already know CC and those getting in touch with the concept. The seminars will be more on the educational sector.<br />

We started the design and search for funds of this projects during 2010, it is part of a 5 year plan to produce material for face-to-face as well as online trainings on the foundation's subjects of interest.<br />
<br />
This specific workshop is the compleition of the first stage in this bigger project, it seeks to leverage the team’s experience, materials and methodology developed during the last 3 years of working with teachers. Additionally, it will provide us with the necessary funds to create two other online versions of the workshop in a period of 3 to 6 months:<br />
<br />
a. A Do it yourself kit for face to face activities. This kit includes a guide together with the necessary props and materials. The material will be an update of the ones currently being used by Karisma within its local activities. The kit is meant to be available online to anyone that wishes to implement the workshop within their own environment. The kit consists basically of a set of files with instructions and the printable material to proceed.<br />
<br />
b. A fully digital version of the workshop to be integrated, for example, in e-learning processes or in virtual courses as a sideline. Files in this case will be ready to be uploaded in an e-learning platform.<br />
<br />
While the face to face workshop that serves as the basis of this digital project is designed for the Colombian context (language and legal framework) it was designed so that it can be used in a global context. In fact it was used in the OCWC meeting in Vietnam with participants from all over the word. Some of the key features that allow the workshop to be compatible in a global context are:<br />
<br />
* Materials are designed in graphic form and with general representations.<br />
* Although it targets a broad linguistic community (Spanish, that is spoken by a large population in different regions) digital versions will be developed with particular sensitivity to the possibility of translation into other languages.<br />
* The workshop explains copyright and licenses issues and especially Creative Commons licenses.<br />
* It will be issued with a CC BYSA license that allows anyone to adapt, improve and share the results.<br />

The comments of the Chilean team to the new MOU.<br />

1.- Enforcement of the License.<br />
According to the clause 1 (a) "The Jurisdiction Licenses shall be consistent with and have the same legal effect as the latest version of the international licenses (currently version 3.0), and be enforceable in the Jurisdiction (the process known as “license adaptation” or “license porting”)."<br />
The way it has been drafted suggets an obligation in the results, which, in my opinion any team can granted. Instead it should be drafted as a obligatins in the means, but not in the results.<br />
<br />
2.- CC0 and Domestic Law<br />
According to the clause 1 (c) "Linguistic Translation of CC0. Affiliate agrees to participate in the linguistic translation of CC0 for the purpose of producing an approved translation of CC0, in adherence with the policies published by CC and made known to Affiliate. The parties will mutually agree on a timetable for producing an approved translation of CC0, together with any other designated leads in the process."<br />
As I have explained in the ISP Policy, at least in Chile thre is not legal certainty that CC0 is a legal tool. In fact, there is an express legal provision that bans waive of rights by author. We have made some lobby at the Congress to get a change in the law, but we haven't been successful yet. We cannot implement a legal solution into the domestic level that is illegal, because it would undermine our credibility and the CC's credibility also.<br />
Can that clause be omited in our MOU, at least for a while?<br />

3.- Unknown CC Policies. <br />
According to the clause I (h) "Further, Affiliate agrees to (...) adhere and publicly promulgate CC positions on matters relating to the public domain, license proliferation, and such other matters as CC makes known to Affiliate, including when responding to public inquiries."<br />
May you provide us with a copy of the actual policies of the CC mentioned. I do not know the ones related with "the public domain, license proliferation,... and (... the one related to) responding to public inquiries".<br />

4.- Hosting Draft of the CC license.<br />
According to the clause II (c) (iii), "Affiliate shall not under any circumstances host or attempt to host any CC Legal Tools (whether in human-readable, lawyer-readable or machine-readable formats, or any other forms or formats whatsoever)."<br />
During the process of discussing draft of the license (implementing process), draft of the license were posted in several places, including some of our own website. As a general policy, we do not delete content, because it undermines credibility, particularly if content does not infringe other people's right.<br />
Should we deleted those draft wherever they are available? Should we inictiate any legal action against third parties that host those contents within our jurisdiction? We would appreciate more explanation.<br />

5.- Data Protection Infringement.<br />
We encourage you to deleted the clause II (d), because the obligation set forth in this about providing personal information infringes the data protection laws of several countries, incuding the European Union members, Chile, Argentina and mexico data protection laws. <br />
Also, I don´t think is good policy show this careless with other jurisdictions law. Particularly in a mattter that is not sensible, but extremely sensitive in countries other than the U.S.<br />
<br />
6.- Hosting content.<br />
According to the clause III (a) "Hosting. CC is solely responsible for hosting any and all CC Legal Tools in human-readable, lawyer-readable and machine-readable formats, including without limitation the Jurisdiction Licenses, the international licenses (including translations thereof), and CC0 (and translations thereof)."<br />
I repeat the same concerns that I have expressed previously in the second comment. CC0 is not clearly legal in our country, and we do not having full knowledge of other "international license". Can you let's know the latter ones? Can we drop the CC0 for a while (while it became clearly legal in our country)?<br />

Responses to some of Alberto's comments:<br />
2. To clarify, CC0 does not get ported. There will be a single translation of it into each language, i.e. one Spanish translation. If a jurisdiction team does not wish to participate in the translation of CC0, that is fine. That jurisdiction may request to have the CC0 clause removed from its MOU.<br />

3. Other policies - This comment made an excellent point. Creative Commons will modify the provision to make it clear that these policies are ones of which Creative Commons has notified the Affiliates.<br />

4. License drafts hosted on non-CC HQ platforms - It would be great if you could take down the old license drafts, but if you cannot, you can keep them up. Please ensure that they are clearly marked as drafts and that there is a link to the actual finalized licenses, to avoid confusion.<br />
<br />
6. Hosting of licenses and legal tools - This provision does not change anything from current obligations. It says that all licenses and legal tools should only be hosted on CC's website. There is no obligation here for the Affiliate team to do, host or support anything.<br />

Following some comments from Carolina Botero and Karisma Foundation from the CC Colombia Jurisdiction<br />

The MOU states jurisdiction's commitments on delivering information, giving legal advise and preparing documents on local activities which I agree, however, I believe some degree of commitment on this issues can also be made up to a certain level from CC's side <br />
<br />
I think that a reasonable issue to include is CC's commitment to deliver a yearly public road map that could serve as a guide to local teams on the topics and activities that CC as our partner is planning to do, this will also be useful when we have to elaborate the yearly road maps and goals and to allign them up to certain point with other jurisdictions globally.<br />
<br />
Also the MOU describes the CC commitment to provide staff that wll be reasonably available for the project, to answer and provide information, while the jurisdiction's commitments go further to actually advise on local legal issues and provide information. CC has always been keen on providing legal information and has built a network of lawyers that supports this, and on specific legal issues CC has worked with local teams. Can't you include a more specific commitment from CCs side that could include this kind of activities as a cooperation frame with the local chapter?<br />

Digital library projects are addressed without considering copyright issues by many of these institutions, while most of the material included is tagged "all rights reserved" often imposing a legal framework that reduces the library´s options for free access.<br />
|community relationship=Karisma is a foundation that works with a vision of what "free" and "open" mean. Karisma supports this kind of approach by actively participating in socio-technológical projects such as the FLOSS community and Creative Commons in Colombia, particularly in the educational sector. Karisma is an affiliate institution of CC in Colombia and CC Co-leader Carolina Botero will coordinate the project.<br />

|participants=The core group would be 3 people including Laura Martinez a commited librarian with expertise on information management. We expect to encourage a community of volunteers to be added to this core group and to broaden the content base.<br />
|impact=Wikimedia projects are currently in the top of the "commons" content providers in the web regarding "free" and "open" content (licensed and under public domain). Without any doubt the platform shares the mision and philosophy of Creative Commons regarding the "commons" and by doing so will increase their impact.<br />
|tech needs=No special skills or expertise are required different from those that hundreds of wikipedians have and can be developed by almost anyone.<br />
|challenges=The most important challeges are:<br />
1. To be able to properly identify contents that are on the public domain or can be licensed under ccbysa. We will rely on the expertise of Karisma`s staff and on the fact that the most interesting material is already more than 150 years old.<br />
2. The scalability of the project depends on the possibility of institutions deciding to contribute this material. Since most of them are public or educational related institutions we are confident "open" and "free" speech can be good arguments.<br />
|sustainability=The project will be feed mainly on content provided by private institutions related to the educational sector, or public institutions such as libraries and museums. We believe this can turn out to be a worthwhile project for them and their objectives, Karisma will be able to join efforts with them to provide sustainability to the project.<br />
|scalability=This project scalability depends first on the wikimedia platform. The high interactivity of the platform allows different institutions and individuals to provide materials as the main resource. The project can be promoted also by special networks such as www.eduteka.org inside the educational sector promoting a remix culture<br />

El equipo de Creative Commons Colombia quiere invitarlos al primer CC Salón, a realizarse en Bogotá el día martes 3 de Febrero de 2009 en el bar Matik Matik.<br />

Los CC Salones son eventos globales que tienen el objetivo de crear una comunidad de artistas y desarrolladores alrededor de las Licencias Creative Commons. El primer evento sucedió en la ciudad de San Francisco en el año de 2006 con la intención de que fuera replicado de manera global. Desde entonces los Salones se han difundido en 15 países alrededor del mundo. <br />

Para éste Salón hemos invitado a tres personas que desde las perspectivas del cine, la música y la web participan de proyectos en los que se comparten contenidos. Ellos son:<br />

1. Diego Ramirez: Hace marketing para Dynamo Capital empresa que invierte en proyectos cinematográficos. Desde allí ha diseñando las estrategias de mercadeo y promoción en medios tradicionales y medios alternativos para proyectos como Satanás y Perro Come Perro entre las cuales han estado las cuales se destacan las [http://www.blog.satanaslapelicula.com/descargas descargas]de contenidos como trailers, música de la banda sonora e imágenes con licencias libres. <br />

2. Andrés Succar: Es el director de la banda de salsa Calambuco cuya música ha sido incluida en varios compilados de distribución internacional, así como en series de televisión y cortometrajes. En vivo han participado en diferentes festivales de Colombia y Venezuela. Algunas de sus temas están disponibles bajo licencias Creative Commons.<br />

3. Claudio Ruiz: Es el Presidente de la ONG Derechos Digitales encargada que promover la protección y promoción de los derechos fundamentales en Internet, también es líder de Creative Commons en Chile. En esta ocasión Claudio, nos hablará del proyecto [http://super45.cl Super 45]portal de Música Independiente creado en Santiago en 1996 y donde se desempeña como Asesor Legal y miembro del Comité editorial.<br />
