What does it mean to be human if we don't have a shared culture? What does a shared culture mean if we can't share it? It's only in the last 100, or 150 years or so, that we started tightly restricting how that culture gets used.

The Internet enabled an infrastructure where anybody could participate without asking permission. We have all these new technologies that allow people to express themselves, take control of their own creative impulses, but the law's getting in the way.

Creative Commons is designed to save the world from failed sharing. People who actually want to share stuff, who put it up on the web because they want to share it under certain terms.

So we wanted to create a simple way, for creators to say to the world here's the freedom that I want to run with my creative work. Here are the things you're allowed to do. Can I reproduce it, can I copy it, can I put it in my text book? Can I use that photograph? Can I make a new version of it? Creative Commons gives tools to creators to make a choice about copyright.

Creative Commons licence can cover anything that copyright covers. Every licence says "You need to give me attribution. I created this, give me credit for the work I did." The basic choices are commercial use, or not. Can you make derivative works, versions, adaptations or not? And do you want me to have to share alike?

So if I take your stuff, do I have to offer it to the next person under the same terms?
There's no requirement for you to do anything with your work other than what you want to do.
You own the copyright to it. What we've done is given you the right to exercise your copyright in more ways, more simply.

So the idea here is to enable the creative impulses that the technology turns loose, and get the law out of the way. The work of Creative Commons is really about laying the infrastructure and ground work for this new type of culture.

A new kind of Folk Culture. Somebody from Delhi, somebody from New York, somebody from Singapore, can feel comfortable using photo that was created and given away by somebody in The United States, or in China, or wherever that the licenses have been extended to. With their identity being preserved. Which means that people can actually create new kinds of things, come together and build things.

Mash-ups that people can do with peoples Flicker photos. And CCmixter has allowed artists to make music together. It's really about creativity and connection. Access and control. From amateurs who simply for the love of what they are doing and they want to share it and they want other people to be able to make use of it, to commercial organizations.

In the end, this will have a very successful place in the for profit economy. Creative Commons is the bridge to this future. You've got to move away from thinking about content to thinking about communities. Communities that develop around content and the sharing that the licences allow enable these communities to come together.

A physical Commons like a park where anybody can enter equally, a Commons with intellectual works is actually much freer. It really is going to be the pillar for communications between people, cultural exchanges. The space for more speech, more free expression. And that's the kind of Commons we're trying to create.

LEAH SAPIN: Arts Engine is a non profit media arts organization and we are dedicated to promoting, producing and distributing social issue media, or media of consequence. And the idea is media is a great tool for a conversation started.

FRED BENENSON: Arts Engine picked up the Creative Commons licenses as a way to help people distribute their media. Arts Engine realized that it was in their interest for people to share the documentaries they were helping promote, and so long as they didn't do it commercially, and didn't make modifications, it was a good plan for Arts Engine to start releasing works that way.

DEAN JANSEN: If a video creator uses Creative Commons on their video, they can mark their video as such, and there are some technical ways they can do that, there are some systems for it. The viewer in Miro can actually see that the video is marked with a Creative Commons license, so that automatically sort of lets people know what they can and can't do with this media.

GRACE LILE: Creative Commons is a great tool for us for online video. We have shown our videos online for many years, but it really ensures that we can share, that we can allow people to copy and re-distribute, but it also ensures for ourselves and for our partners that we're maintaining the integrity of the work.

JEN SIMMONS: I have really been thrilled with the way that Media That Matters has distributed "Bush 4 Peace." You took it on tour to a lot of festivals around all sorts of places, and then really got it online at a time when not many people were putting video online. And it's now years later, like five years later, and I think it's still being seen all over the place because of the work that Media That Matters did to put it out on the internet.

NIAZ MOSHARRAF: It's basically every filmmaker's dream. You want to be able to use other sources, you want to use other archival footage that you're not going to get sued for.

JEREMIAH ALEXIS: What's happening is as more people are using their computers as a central means of entertainment and watching all their media on their computer, having a license like Creative Commons is an amazing way to spread your media.

ELIZABETH MANDEL: We used the music of an artist by the name of DZK in our film "Arctic Son," and had he had a record company or a publishing house in the process, we could never have afforded to use his song. But because we found his song online through Creative Commons, we were able to use a great piece of music for our film, and he was able to bring his film to an audience that might never have heard it otherwise.

GINA TELAROLI: It gives you as an artist protection and the control over what people can do with your media, while at the same time allowing people the freedom to share your work, to get your work out into the world, and to, if you want them to, use your work to create their own work. There's a lot of different ways you can control what is done with your films but withour limiting people and their access to it.

JEN SIMMONS: I think Creative Commons has given our film the chance to really travel around the planet, and people have been passing it from person to person and sharing it with lots and lots of people. I think "Bush 4 Peace" has probably gone out to several hundred thousand people, and that's because of the internet, it's because of internet video, and it's because of things like Creative Commons.

DEAN JANSEN: Now it's just up to the media makers, to sort of learn about this stuff, to sort of learn about the advantages of open distribution, and take advantage of them.

JEREMIAH ALEXIS: I think it's a great means of opening up your media, particularly as a young filmmaker, and allowing many people to watch your film and your product.

FRED BENENSON: There are a lot of creators who are just starting off as well as really big names who have used Creative Commons as a way to encourage people to share and really push on the promise of technology to help distribute culture.

ELIZABETH MANDEL: I see Creative Commons and the free exchange of creative ideas and the sharing of artistic works as only enhancing and benefitting everyone.

NIAZ MOSHARRAF: The whole idea of creating media and creating these films is to reach out to people, to show them to people, to open their minds, or introduce new ideas. How can we do that, if you're just stopping this flow of knowledge, this flow of ideas?

GINA TELAROLI: I think new filmmakers have to embrace kind of the new media that's happening and to think about ways to make that work with what you're doing aesthetically, and what you're doing with your content. There's a lot of great tools out there and I think filmmakers--a lot of people are making films and they're kind of holding on to their old world dreams of what success is, and how films can get out there. So it'd be really great to see filmmakers embrace new media in a way that makes it really powerful for the filmmaker.

LEAH SAPIN: I think Arts Engine is really excited about working with Creative Commons. I think we've worked together for a number of years and because we have these different programs, we're seeing the possibilities open up in terms of how we can really work together. And I think it's only the beginning and I'm excited about seeing what can happen.

In our last episode you met Creative Commons, a young project with big plans, plans to bring some sense to the copyright debate, plans to partner with the big C, to clarify the rules of creativity. To help authors and artists build a body of free culture they can draw from in return. So where have Creative Commons' adventures led?

It all began with our copyright licenses, tools that help you mark your work as free to share or build upon with only some rights reserved. And you did just that, with an enthusiasm that surprised even us. First came the early adopters: writers, like Campbell Award winning Cory Doctorow, who offered fans his first novel for free download, and for sale in hard copy; educators, like MIT and Rice University, who made their courseware available online, for free, to the world; also, community builders like Sal Randolph of Opsound, who collects hundreds of licensed songs for people to remix and share; and there are thousands of modern day Thomas Paines, the grassroots journalists known as Webloggers, plus photographers, illustrators, filmmakers, and more. Only a couple of months into Creative Commons' life, and more than 100,000 pioneers like these had joined the movement.

And then things got really interesting. Because before long, YOU put this commons into practice, just as we had dreamed but could never have done alone. Guitarist Colin Mutchler contributed a track to Opsound and a young violinist named Cora Beth recorded a duet with him without ever meeting him. An academic program in Vietnam began translating and teaching MIT's course materials. Cory Doctorow's novel sold a whole print run. It saw hundreds of thousands of downloads. Even Jeff Bezos, CEO of Amazon.com recommended it to his customers. All of this, across the net, with no middleman, no legal doubt, no friction, just free culture created in real-time.

All the while you built the commons out in whole new directions, in ways we never anticipated. High-tech publisher Tim O'Reilly helped us create the Founder's Copyright; that's fourteen years in the care of Big C, and then works move onto public pastures. Software developers started incorporating our tools, helping people free their works at the point of creation. Common Content and the Internet Archive began to register and host Creative Commons works, for free. The iCommons opened, and experts around the world began porting our licenses to many legal systems, so that your expression can travel freely across borders.

And suddenly, what had been only an idea only eight months earlier was a global movement, more than 700,000 licensed works strong, and still you helped us realize that more could be done. The legendary musician Gilberto Gil, along with the digital collage artists Negativland, inspired us to build Creative Commons latest and most exciting tool, one that encourages a kind of creativity that children with scissors and glue, and scientists who cure with genes, and lawyers who cite precedent understand as second nature, to take a bit and make it new. Some from here, some from there, to make a mosaic of the old, but not to copy -- to remix culture. Introducing: the Creative Commons Sampling Licenses. New tools to help you invite others to get creative with a part of your work, even for profit, but not to copy the whole thing. The legendary Mr. Gil will introduce the first wave of sample friendly tunes from Brazil, leaving you free to jam with him across the net, with more artists soon to follow.

And so, Creative Commons carries on, twelve months since hitting the scene, more than one million licensed works, one million artifacts of culture, free to reuse. And we've got bigger plans still: plans to help authors republish books out of print; plans to explore a science commons; plans to weave our philosophy and our tools into the fabric of the net; plans to knock down the wall between reader and author, or listener and composer, between audience and artists, between community and citizen, or culture and creator; plans to bring creativity back to its senses, and with your help, to keep growing, just as big as the old Big C.

Creative Commons: the rules have changed, and it's just the beginning.

These people know that when you share your creative wealth, you can accomplish great things. They and millions of other people all around the planet are working together to build a richer, better, more vibrant culture, using Creative Commons.

To understand Creative Commons, you need to know a little bit about how copyright works. Did you know that when you create something, anything, from a photograph, to a song, to a drawing, to a film, to a story, you automatically own an "All rights reserved" copyright to that creativity.
